Terms of Service

Welcome to TrimForge. These Terms of Service ("Terms") govern your access to and use of the TrimForge website, APIs, software, services, and related products (collectively, the "Services"). By creating an account, purchasing a subscription, obtaining an API key, or using the Services, you agree to these Terms. If you do not agree with these Terms, you must not use the Services.

1. About TrimForge

TrimForge provides developer-focused image processing services, including background removal, image trimming, and related image-processing capabilities through APIs and associated tools.

TrimForge may provide REST APIs, SDKs, dashboards, documentation, and other tools to enable customers to integrate image processing into their applications and workflows.

2. Eligibility

You must be legally capable of entering into a binding agreement to use the Services.

If you use TrimForge on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms.

3. Account Registration

Certain features require you to create an account.

You agree to:

  • Provide accurate and current account information.
  • Keep your login credentials confidential.
  • Keep your API keys secure.
  • Notify us promptly if you believe your account or API credentials have been compromised.
  • Accept responsibility for activity performed through your account or API credentials.

You must not share, sell, transfer, or publicly expose your API credentials.

TrimForge may suspend or restrict accounts where we reasonably believe there has been unauthorized access, abuse, fraud, or violation of these Terms.

4. Use of the Services

You may use TrimForge to process images and integrate image-processing functionality into applications, websites, software, and business workflows, subject to these Terms.

You agree not to use the Services to:

  • Violate any applicable law or regulation.
  • Infringe intellectual property, privacy, publicity, or other rights of another person.
  • Process content that you do not have the legal right to process.
  • Upload or process malicious software, viruses, or other harmful code.
  • Attempt to gain unauthorized access to TrimForge systems.
  • Circumvent usage limits, authentication, billing, or security controls.
  • Reverse engineer, decompile, or attempt to extract proprietary models, algorithms, or systems from the Services.
  • Interfere with or disrupt the operation of the Services.
  • Abuse the API through excessive automated requests intended to degrade service availability.
  • Use the Services for fraudulent, deceptive, or unlawful activities.

We reserve the right to investigate suspected violations and take appropriate action.

5. Your Content

You retain ownership of images and other content that you submit to TrimForge ("Customer Content").

You represent and warrant that you have all necessary rights, licenses, permissions, and legal authority to upload and process Customer Content through the Services.

You grant TrimForge a limited, non-exclusive, worldwide, temporary license to access, process, transmit, and store Customer Content only as reasonably necessary to provide, secure, maintain, and improve the Services.

Unless otherwise expressly agreed with you, TrimForge does not use Customer Content to train its artificial intelligence or machine-learning models.

6. Image Processing and Data Handling

TrimForge is designed to process submitted images temporarily as part of providing the Services.

Images may be held temporarily in memory or transient processing infrastructure while an API request is being processed.

After processing is completed and the response is delivered, Customer Content is intended to be deleted from temporary processing systems in accordance with our Privacy Policy and technical retention procedures.

You acknowledge that no internet-based service can guarantee absolute security or uninterrupted availability.

7. API Usage and Credits

Certain TrimForge plans operate using credits or other usage-based limits.

Unless otherwise specified:

  • One successful API request that returns a processed image consumes one credit.
  • Failed requests caused by invalid input or API errors generally do not consume a credit.
  • Usage limits may vary depending on your subscription plan.
  • TrimForge may implement reasonable technical limits to protect service availability and prevent abuse.
  • We may modify credit definitions, usage limits, or API functionality from time to time.

8. Subscriptions and Billing

TrimForge may offer paid subscription plans, including monthly or other billing arrangements displayed on the website or within your account.

By purchasing a paid plan, you authorize the applicable payment provider to charge the fees associated with your selected plan.

Subscription fees are generally billed in advance according to the billing period selected at checkout.

Prices may change from time to time. Any changes to recurring subscription pricing will be communicated through reasonable means before they take effect for future billing periods.

9. Upgrades, Downgrades, and Cancellation

Where supported by your account, you may upgrade, downgrade, pause, or cancel your subscription through your TrimForge account.

Unless otherwise stated:

  • Cancellation stops future recurring charges.
  • Your current subscription may remain active until the end of the applicable billing period.
  • Previous usage and charges are not automatically refunded because of cancellation.
  • Any refunds will be handled according to the refund terms presented at the time of purchase or as otherwise determined by TrimForge.

10. Refunds

Except where required by applicable law or expressly stated otherwise, subscription payments are non-refundable.

If you believe you were incorrectly charged, you may contact us at api@trimforge.com with relevant billing information.

We may review refund requests on a case-by-case basis.

11. Intellectual Property

The TrimForge Services, including the website, software, APIs, documentation, branding, design, technology, and underlying systems, are owned by or licensed to TrimForge and are protected by applicable intellectual property laws.

These Terms do not transfer ownership of TrimForge intellectual property to you.

You may use the Services only as expressly permitted under these Terms.

12. Third-Party Services

TrimForge may rely on third-party infrastructure, hosting providers, payment processors, authentication providers, content delivery networks, analytics providers, or other service providers.

Your use of certain third-party services may also be subject to their respective terms and policies.

TrimForge is not responsible for the availability or performance of third-party services outside our reasonable control.

13. Service Availability

We aim to provide reliable and high-performance Services, but we do not guarantee that the Services will:

  • Always be available.
  • Operate without interruption.
  • Be completely error-free.
  • Process every image successfully.
  • Always meet a particular processing time.

We may temporarily suspend Services for maintenance, security, upgrades, emergency repairs, or circumstances beyond our reasonable control.

14. Beta Features

TrimForge may occasionally provide experimental, beta, preview, or newly released features.

Such features may be modified, suspended, or discontinued at any time and may contain errors or limitations.

15. Disclaimer

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

TrimForge makes no warranties, express or implied, regarding the Services, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or uninterrupted operation.

Image-processing results may vary depending on image quality, subject matter, format, complexity, and other technical factors.

16. Limitation of Liability

To the maximum extent permitted by law, TrimForge and its owners, officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.

To the maximum extent permitted by law, TrimForge's total aggregate liability arising from or relating to the Services will not exceed the amount you paid to TrimForge for the Services during the three months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. Indemnification

You agree to defend, indemnify, and hold harmless TrimForge and its owners, officers, employees, contractors, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from:

  • Your use or misuse of the Services.
  • Your Customer Content.
  • Your violation of these Terms.
  • Your violation of applicable law.
  • Your infringement of another party's rights.

18. Suspension and Termination

We may suspend or terminate your access to the Services if:

  • You materially violate these Terms.
  • Your use creates a security or operational risk.
  • You engage in fraudulent or abusive activity.
  • You fail to pay applicable fees.
  • We are required to do so by law.
  • We discontinue the relevant Services.

You may stop using the Services at any time. Upon termination, your right to use the Services will cease. Provisions that by their nature should survive termination will remain effective.

19. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may update the "Last Updated" date and provide additional notice where appropriate.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.

20. Governing Law

These Terms will be governed by and interpreted in accordance with the applicable laws of India, without regard to conflict-of-law principles.

Any disputes will be subject to the jurisdiction of the courts having appropriate jurisdiction in India, unless otherwise required by applicable law.
